Essential Safety Measures (ESMs) are crucial safety systems installed within properties that require ongoing inspection and testing. As part of your Conditions of Occupancy, these must be maintained in accordance with various Australian Standards and maintained to a compliant state for the building to remain occupied. Failure to meet these obligations can result in fines and in some cases eviction.

During the construction of any property there is numerous service providers completing different components of the construction. At completion, compliance certificates need to be prepared by these trades and the Responsible Building Surveyor will confirm receipt and mark off prior to issuing the Occupancy Permit. As not all trade services require independent third-party certification some systems can easily be signed of without being compliant.

An Occupancy Permit is a document issued by the Building Surveyor indicating the property is suitable for habitation. It is not a certificate of compliance regarding your essential safety services, but rather a reflection that all the fundamental requirements have been met. These are things such but not limited to having running water, waste services, gas and electrical service along with general construction requirements being met.

Properties that have defective essential safety services are at risk of receiving building orders, which if not met can result in fines. Additionally, while defects are present the property is not fully insured as your insurer has grounds to reject any claim relating to damage or loss of life that could have been prevented if your essential safety measures were compliant.
